Terms of Service

1. What 24-7 SMS is

24-7 SMS ("we", "us") provides an AI-powered SMS lead-response service for businesses. When your business subscribes, inbound text messages to your connected number receive automated AI replies, leads are qualified, and conversations are made available to you in an owner dashboard. These Terms are an agreement between 24-7 SMS and the business that subscribes ("you").

2. Free trial and billing

• New subscriptions start with a 7-day free trial. A valid payment method is required to start the trial.
• Unless you cancel before the trial ends, your subscription automatically converts to a paid plan of $199 CAD per month, billed monthly in advance.
• You can cancel anytime. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable except where required by law.
• Payments are processed by Stripe. We do not store your card details.

3. Your responsibilities

• You confirm you have the right to use the phone number(s) connected to the service and to receive and respond to messages sent to them.
• You are responsible for how you use lead information collected by the service, including complying with applicable laws such as Canada's Anti-Spam Legislation (CASL) and applicable telecom messaging rules.
• You will not use the service for unlawful, deceptive, or abusive messaging, or for sending unsolicited bulk messages.

4. AI-generated responses

Replies to your customers are generated by artificial intelligence based on the configuration set up for your business. AI output can occasionally be inaccurate or incomplete. You are responsible for reviewing lead information before acting on it, and for any commitments made to your customers. We do not guarantee that any particular lead will convert or that every message will be answered without error or interruption.

5. Service availability

We aim to keep the service running continuously, but we depend on third-party providers (including telecom carriers and messaging infrastructure) and do not guarantee uninterrupted availability. We may update, improve, or modify the service over time.

6. Data

Message content, phone numbers, and lead details processed through the service are handled as described in our Privacy Policy. You retain ownership of your business data; you grant us the rights needed to operate the service on your behalf.

7. Limitation of liability

To the maximum extent permitted by law, 24-7 SMS is not liable for indirect, incidental, or consequential damages, including lost profits or lost business opportunities. Our total liability for any claim relating to the service is limited to the amount you paid us in the three months before the claim arose.

8. Termination

You can cancel your subscription at any time. We may suspend or terminate service for non-payment or for use that violates these Terms, with notice where reasonably possible.

9. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify active subscribers. Continued use of the service after changes take effect means you accept the updated Terms.
